ORLANDO, Fla. (Legal Newsline) - Under Armour faces a wrongful death lawsuit in Florida over the murder of an assistant manager at the Orlando International Premium Outlets.
The brothers of Eunice Marie Vazquez Rosado filed suit Feb. 8 in Orange County Circuit Court against Under Armour and Simon Property Group over her Feb. 10, 2020, shooting death at the hands of a fired manager.
Eunice and other employees had complained about manager Daniel Everett, but their gripes weren't kept confidential, the lawsuit says. After Everett was fired on the morning of Feb. 10, he purchased a rifle with an Under Armour company credit card that was not canceled, the suit says.
Everett's plan was to murder all employees he believed caused him to be fired and prepared a suicide letter for his wife and daughter, the suit says. He also drafted a "hit list," on which was Eunice.
SPG, the property owner, is accused of having inadequate security. Everett shot Eunice point-blank at the Under Armour store, couldn't find another assistant manager who was on break and committed suicide, the suit says.
"Eunice was murdered as a result of UA engaging in conduct that it knew, based on Everett's prior similar actions and/or explicit warnings it received specifically identifying that there was a known danger, which was virtually certain to result in injury or death to Eunice, and Eunice was not aware of the risk because UA concealed, misrepresented, failed to act and/or warn, failed to have adequate security, failed to do so as to offer any protection to Eunice and to prevent Eunice from exercising her informed judgment as to the danger that existed," the suit says.
Rosado's estate is represented by Dusty Aker of the Aker Law Firm in Sarasota. Eunice was 27 years old.
