ORLANDO, Fla. (Legal Newsline) - A Florida man's lawsuit says his family vacation at an Orlando resort was marred by two instances of physical violence instigated by a group of rowdy guests.
Marc Migliaccio sued Wyndham Grand Orlando Resort Bonnet Creek on Feb. 2 in Orange County Circuit Court, alleging hotel staff failed to control a group of partiers in July 2020. The suit says their loud music, provocative dancing and drinking disturbed those around them at the resort's pool.
Twice, staff asked the group to turn its music down but were unsuccessful, the suit says. When the group began packing their belongings, pool-goers cheered, which made matters worse, it adds.
One of the partiers threw a water bottle that hit his wife, Migliaccio says. When he tried to find out who threw it, an unknown assailant kicked him in the eye, he says.
Police responded but the kicker was never found. Later, the suit says, Migliaccio and his wife ran across two members of the group at a bar at the resort, leading to a verbal altercation, the suit says.
A member of resort staff grabbed Migliaccio's arms, which helped one of the men punch him in the same eye that was kicked earlier, he says.
"Unfortunately, no one under the direction and/or employ of Defendants reported this subsequent incident to law enforcement and this individual, as well as the individual who kicked him earlier in the day, are still at large," the suit says.
The plaintiff's lawyer is James Simmons of Orlando.
