Man sues manufacturer of Alligator Shear after injuring his hand

BOSTON (Legal Newsline) - Carlos Reyes filed a lawsuit on Dec. 20 in Massachusetts' Suffolk County Superior Court against Gensco America and Scrap It, Inc. for negligence and breach of warranty.

According to the lawsuit, Reyes was caused to suffer substantial personal injury due to a foot pedal accidentally being activated on a Genesco Alligator Shear that was designed, developed, assembled, manufactured, tested and sold by Gensco America.

Defendant is alleged to have negligently designed, developed, assembled, manufactured, inspected, tested, marketed, advertised, sold, and distributed said Alligator Shear; negligently failed to warn or instruct or adequately warn users of product about its dangerous and defective characteristics; negligently failed to equip said Alligator Shear with adequate point of operation guards; and negligently failed to provide said Alligator Shear with a foot pedal which was designed to prevent or minimize the possibility of inadvertent activation. 

Reyes was caused to suffer severe damage to his hand, the suit says.

Reyes seeks judgment, interest and costs. Reyes is represented by James A. Swartz of Boston.
