Memory improvement supplement company sued for fraudulent labeling

LOS ANGELES (Legal Newsline) - Brent Scarpo filed a federal class action lawsuit on Nov. 22 in the Central District of California against Natrol LLC for violation of the unfair competition law, violation of the consumer legal remedies act and breach of express warranty.

According to the complaint, Natrol manufactures, distributes and sells “Natrol Cognium® Memory” and “Natrol Cognium® Memory Extra Strength” advertised to improve memory and recall and contain the “#1 most clinically studied ingredient for memory.” 

“Cognium” refers to silk protein hydrolysate, and the product packaging claims “Cognium Memory is powered by natural protein from silkworm cocoons.” Silk protein hydrolysate, which has less protein than a piece of bread, does not have any effect on brain health or memory improvement, making the claims and packaging false and misleading to consumers, the suit says.

Scarpo seeks certifying the class as requested, enjoining Natrol's misleading marketing campaign, awarding Plaintiff and class members damages, restitution and disgorgement, attorney fees and cost of suit. Scarpo is represented by Annick M. Persinger of L.A.
