Fatal accident in Boston leads to lawsuit

BOSTON (Legal Newsline) - The Estate of Diane Ly filed a complaint Oct. 13 in Suffolk County Superior Court over a fatal accident in Boston.

The defendants are ACC Transportation Group, Inc., Above All Transportation, Inc., Matthew Coyle, Crosby Schlessinger, Smallridge LLC and McMahon Associates, Inc., who are charged with wrongful death, vicarious liability/respondeat superior and negligent hiring, supervision, training and retention.

According to the complaint, on Sept. 11, 2019, Diane was visiting Boston to see her boyfriend. She was waiting at a corner with her boyfriend when the pedestrian signal displayed a "walking person" in white, and both began to cross the intersection, the suit says. 

Unknowingly to the couple, the timing system in place utilized a concurrent pedestrian phase that gives the signal to cross while conflicting vehicular traffic is permitted to proceed through the intersection at the cross at the same time, the suit claims. The couple were a little over halfway through the intersection when Diane was hit and dragged under a van. \

Diane did not survive the impact, and was pronounced dead at 9:54 p.m. due to internal injuries. 

The Estate of Diane Ly seeks damages and is represented by Jeffrey N. Catalano and John A. Hammerstrand.
