Coca-Cola sued over Pina Colada-flavored Fanta drinks

Federal Court

WHITE PLAINS, N.Y. (Legal Newsline) - Janie Hawkins, individually and on behalf of all others similarly situated, filed a federal class action complaint on October 28 in the Southern District of New York against The Coca-Cola Company over Fanta sodas.

According to the complaint, Coca-Cola manufactures, packages, labels, markets, and sells piña colada-flavored soda under the Fanta brand purporting to have “100% Natural Flavors.” The piña colada is a cocktail made with rum, cream of coconut or coconut milk, and pineapple juice, usually served either blended or shaken with ice.

Hawkins alleges that Defendant markets the products as having 100% natural flavors, but the ingredients listed on the back are contrary to this statement, as more of the ingredients come from artificial and synthetic flavors, making the labeling misrepresenting and fraudulent.

Hawkins seeks preliminary and permanent injunctive relief by directing the defendant to correct the challenged practices to comply with the law; injunctive relief for the Defendant to remove or correct the practices of misrepresentation, monetary damages, punitive damages, costs and expenses and attorney's fees. Hawkins is represented by Spencer Sheehan of Sheehan and Associates, P.C.
