Pan Am Railways sued over former employee's cancer

BOSTON (Legal Newsline) - Wayne A. Terry, Sr. filed a complaint on September 16 in the Suffolk County Superior Court in Massachusetts against Pan Am Railways f/k/a Boston & Maine Railroad and Springfield Terminal Railway Company for negligence. 

According to the complaint, Terry was employed by Boston & Maine Railroad, Springfield Terminal Railway Company and Guilford Transportation Industries from 1988 to 2017. During his employment, he was exposed to excessive and harmful amounts of toxic substances, including diesel exhaust, creosote, asbestos and second-hand smoke while working as a trackman and machine operator, the suit claims. 

Terry alleges the exposures caused or contributed to his development of tonsil cancer, diagnosed in March 2020. Terry alleges it was the negligence of the defendants for not providing a safe work environment despite knowing the hazardous conditions.
