Lawsuit blames Airbnb for broken neck after fall down stairs

HOT SPRINGS, Ark. (Legal Newsline) - A Texas woman is suing Airbnb and the Arkansas rental property she stayed for allegedly falling and sustaining a broken neck.

Niacole Borecki filed a complaint on September 20 in Garland County Circuit Court against B&S Williamson Marital Trust, Airbnb Insurance Agency, LLC, Airbnb Payments, Inc., Airbnb, Inc., John Does 1-3 and John Doe Entitles 1-3 for negligence, breach of contract and respondeat superior.

According to the complaint, on Oct. 11, 2020, Borecki was on vacation at the Williamson Trust's rental property as advertised on Airbnb, and while walking down the stairs, she slipped and fell, which caused substantial injuries including a broken neck. Borecki alleges that the rental property's carpeted stairs were too narrow and hazardous and the handrail was too close to the wall for her to grab to stop herself from falling. 

Borecki seeks monetary compensation, post-judgment interests, 12% penalty for the awarded damages, and other relief she may be entitled to. Borecki is represented by Jake Logan.
