Woman sues Dollar General over graham crackers

PEORIA, Ill. (Legal Newsline) - Dawn Hauger filed a federal class action complaint on September 23 in the Central District of Illinois against Dollar General Corporation negligent misrepresentation, fraud and unjust enrichment, among other claims.

According to the complaint, the Dollar General Corporation manufactures, labels, markets, and sells crackers purporting to be made predominantly with whole-grain graham flour and sweetened primarily with honey under its Clover Valley brand. 

The relevant front label representations include “Honey Graham Crackers,” a dripping honey dipper, “Made With Real Honey,” “Contains 8g of whole grain per serving,” and “No high fructose corn syrup.” Hauger alleges that this is consumer fraud due to the graham crackers not including “Graham Flour (Whole Wheat Flour)” as its primary flour as it is listed below “Enriched Wheat Flour” and the product is sweetened primarily with sugar and has a minuscule amount of actual honey in it. 

Hauger seeks preliminary and permanent injunctive relief by directing the defendant to correct the challenged practices to comply with the law; injunctive relief to remove, correct and/or refrain from the challenged practices and representations; monetary damages, statutory and punitive damages, costs and expenses, attorney's fees and cost of suit.
