Woman sues Kellogg over 'veggie' products

SAN FRANCISCO (Legal Newsline) - Kellogg's faces a class action lawsuit that says its veggie products don't contain enough vegetables.

Angela Kennard filed a federal lawsuit on September 17 in the Northern District of California against Kellogg Sales Company for violation of the California Consumers Legal Remedies Act, violation of the False Advertising Law, Cal. Bus. & Prof. Code, violation of the Unfair Competition Law, Cal. Bus. & Prof. Code, breach of express warranty and breach of implied warranty. 

According to the complaint, Kellogg is the manufacturer and seller of Morningstar Farms “VEGGIE” products but this representation is false or at least highly misleading because the predominant non-water ingredient in all of the veggie products is not vegetables — or even vegetable-based — but instead, grain or oil. 

The first three ingredients in Kellogg’s MorningStar Farms’ “VEGGIE DOGS” are “Water, wheat gluten, [and] corn syrup solids. The veggie products’ “VEGGIE” labeling violates both federal food labeling laws and California Health and Safety Code, the suit alleges.

Kennard alleges that she would not have purchased the product, not paid the price she had for the product, if it were not for the misrepresentation labeling and deceptive claims and practices of the company intentionally made in mislabeling its product.
