BOSTON (Legal Newsline) - Francis Del Tufo filed a complaint on August 30 in Suffolk County Superior Court in Massachusetts against Philip Morris USA Inc., R.J. Reynolds Tobacco Company and Stop and Shop Supermarket Company for breach of warranty, negligence, civil conspiracy and duty to warn.
According to the complaint, Del Tufo developed squamous cell carcinoma of the left lung caused by the defendants’ Marlboro, Parliament and Newport brand cigarettes and the negligent, misleading and fraudulent marketing, distribution and sale of the cigarettes.
Del Tufo alleges that Marlboro and Parliament cigarettes were defective, unreasonably dangerous and highly addictive and should not have been sold to him at any time. Del Tufo alleges Philip Morris and R.J. Reynolds and its predecessor entities, through their employees and agents, handed out free cigarette samples and promotional items, and specially designed advertisements used to appeal to young adults, including children, to attract long-term customers.
Del Tufo requests judgment for damages including pain and suffering, medical expenses and recoverable costs of this action and all legally recoverable interest. Del Tufo is represented by Michael R. Tein.
