Canada Goose faces lawsuit over down in jackets

NEW YORK (Legal Newsline) - A class action lawsuit takes aim at the way Canada Goose describes the down in its clothing products.

Jia Wang Lin filed a federal class action complaint on September 12 in the Southern District of New York against Canada Goose US. According to the complaint, Canada Goose US manufactures clothing products, the majority of which contain down. 

Canada Goose US allegedly advertises and falsely claims that “our down blends all contain Canadian Hutterite down, which is among the highest quality Canadian down available, enabling us to manufacture lighter jackets without sacrificing warmth.” 

“Hutterite” refers to a group of Christian communities largely in Canada with a reputation for raising excellent geese. The undue emphasis on the Hutterite origin of the down as an indicator of its thermal performance has no factual basis, Lin alleges. 

Therefore, Hutterite goose husbandry would make no difference one way or the other to the quality of the down obtained from a given species of goose. According to a Chinese government report of its investigation into Canada Goose products, goose down accounted for only 16.8%, while duck down accounted for 83.2%, of the down used in 190 down jackets sampled. 

Lin alleges consumers would not buy the products of Canada Goose had they know that the misleading and misrepresentation advertising were not based on factual premises. 

Lin seeks for the court to enjoin the Defendant's illegal conduct, awards of restitution, statutory damages and punitive damages. Lin is represented by John Troy or Troy Law, PLLC.
