LOS ANGELES (Legal Newsline) - Banana Boat "Reef Friendly" products contain ingredients that are actually harmful to reefs and other marine life, a new class action lawsuit says.
Mary Condreay filed a federal class action complaint on September 2 in the Central District of California against Edgewell Personal Care Brands, LLC for violation of California's Consumer Legal Remedies Act, violation of California's False Advertising Law, violation of California's Unfair Competition law, breach of express warranty and breach of implied warranty.
According to the complaint, Banana Boat “Reef Friendly" suntan lotions contain label that leads consumers to believe that the products are “Reef Friendly,” when in fact, they are not.
Specifically, the suit says, there are at least two active ingredients in the products, avobenzone and octocrylene, that are not safe for coral reefs and other marine life and are on the Haereticus Environment Laboratory’s list of ingredients that are unsafe for ocean systems. Moreover, octocrylene is on the National Ocean Service’s list of common chemicals in sunscreen that can be harmful to marine life, the suit says.
Condreay seeks for the court to declare the Defendant in violation of above codes and laws, statutory damages, monetary damages, punitive damages, interest, cost of suit and attorney's fees. Condreay is represented by Benjamin Heikali of Faruqi and Farqui, LLP.
