Lawsuit says Harley-Davidson motorcycle helmets are weaker than advertised, caused man's death

FAYETTEVILLE, Ark. (Legal Newsline) - A family is suing Harley-Davidson after a man died in a motorcycle crash.

Benjamin Andrew and Ann Marie Watts, individually and as co-special administrators of the estate of Hunter Dakota Wayne Watts, deceased, and on behalf of the wrongful death beneficiaries of Hunter Dakota Wayne Watts, filed a complaint on August 18 in the Circuit Court of Washington County, Arkansas, against Harley-Davidson Inc., Northwest Arkansas Motorcycles, LLC d/b/a Pig Trail Harley-Davidson and John Does 1-3 for strict liability, negligence, breach of implied warranty and breach of express warranty.

According to the complaint, on August 23, 2018, Hunter Dakota Wayne Watts was involved in an motorcycle accident and suffered serious injury to his face and head during the accident, which resulted in his death. At the time of the accident, it is alleged that Hunter Dakota Wayne Watts was wearing a Harley-Davidson brand Lincoln-M02 helmet and was wearing it in the proper fashion. 

The helmet is advertised to be made of polycarbonate, but is actually constructed of ABS plastic, a much cheaper and weaker material prone to tearing, splitting and shearing, the suit claims. Watts' family alleges that the helmet therefore was defective and was responsible for Hunter's death.
