Domino's franchise owner sued for not honoring national advertisement

LOS ANGELES (Legal Newsline) - Some Domino's Pizzas won't honor coupons, a lawsuit is alleging.

Ronald D. Traer filed a federal class action complaint on July 30 in the U.S. District Court for the Central District of California against Domino's Pizza and franchisee Fernando Tapia for violation of California's Consumer Legal Remedies Act, violation of California's Unfair Competition Law, violation of California's False Advertising Law, breach of express warranty, unjust enrichment and fraud. 

According to the complaint, Tapia operates a chain of Domino's franchises in California and jointly and severally advertises and markets from the National Advertising Fund run by Domino's. 

Traer alleges that under the advertising and marketing of Domino's is the "Mix and Match Deal," which allows customers to "choose any 2 or more for $5.99 each." Traer alleges that Tapia does not honor the advertising and marketing, but instead charges customers more for the products included in the deal offered by Domino's. 

Traer seeks injunctive relief, restitution, pre-judgement interest, cost of suit and attorney's fees. Traer is represented by John Glugoski.
