Woman sues airlines for not refunding her ticket after COVID-19 shutdown

SAN FRANCISCO (Legal Newsline) - Gemnaika Flores filed a federal class action lawsuit on July 22 in the U.S. District Court for the Northern District of California against Philippine Airlines, Inc. and PAL Holdings, Inc. for breach of contract, unjust enrichment and fraud.

According to the complaint, because of the outbreak of the coronavirus, PAL has canceled a vast percentage of its international and U.S. flights. However, PAL has refused to issue refunds for flights that it canceled or significantly altered, the suit says.

PAL’s inexplicable and continuous withholding of passengers’ refunds stands in direct contravention of its Contract of Carriage as well as other representations made to passengers, the suit says. Flores alleges that she is a victim of not being refunded for her booked flight, and lists many others she has contacted that experienced the same issues with PAL, the suit says. 

Flores allegedly was told by PAL that her refund would be given to her and that she should “allow 3-6 months processing,” but after that timeframe had passed, she still had not, and has not, received her refund.
