Vizzy Hard Seltzers aren't as healthy as advertised, lawsuit alleges

SAN FRANCISCO (Legal Newsline) - Plaintiff Joseph Wagner filed a federal class action lawsuit on July 15 in the U.S. District Court for the Northern District of California against Molson Coors Beverage Company, claiming its hard seltzer is marketed as healthy but isn't.

According to the complaint, Molson Coors Beverage Company markets its Vizzy Hard Seltzer as “better for you” products that are healthier than other alternatives in food and beverage categories that are not typically healthy. 

Wagner alleges that it is due to this labeling and marketing that consumers choose to purchase and consume this product under the impression that it is healthier than traditional adult beverages. Wagner alleges that the seltzer is not in fact healthier for you and does not contain the fruit elements it alleges to have, nor doesit contain the “Antioxidants Vitamin C from Acerola Superfruit” as listed in the products labeling. 

Therefore, it is false advertising and fraud on the company's behalf to sell products under this misrepresentation, the suit claims.

Wagner seeks compensatory damages, statutory damages, punitive damages, treble damages, restitution, attorney's fees and cost of suit. Wagner is represented by Hayley Reynolds of Gutride Safier LLP.
