Cincinnati Reds fight former player's choice of jurisdiction for Workers' Comp claim

LOS ANGELES (Legal Newsline) -- Major League Baseball's Cincinnati Reds are suing over a Workers' Compensation claim. 

The Cincinnati Reds LLC filed a complaint on July 9 in the U.S. District Court for the Central District of California against former minor leaguer Anthony Esquer seeking declaratory and injunctive relief for violation of due process. 

According to the complaint, Esquer filed a claim against the Reds with the California Workers’ Compensation Appeals Board (“WCAB”) and seeks to have that agency exercise personal jurisdiction over the Reds under California Labor Code Sections 3600.5(a) and 5305.

The Reds allege that Esquer’s invocation of WCAB jurisdiction under California Labor Code violates its right to Due Process of Law as it does not support empowering the WCAB to exercise personal jurisdiction over out-of-state defendants in a manner that violates the Due Process Clause.

The Cincinnati Reds seek for the court to permanently be restrained and enjoined from prosecuting the claim Esquer has filed against the Reds, who are represented by Jerome M. Jackson and Timothy Peterson of Bober, Peterson and Koby, LLP.
