NEW YORK (Legal Newsline) - A man claims to have been seriously injured while on the job by a gas power demo saw that he was not given proper safety gear for.

Gerardo Valencia filed a complaint on May 17 in New York County Supreme Court against Triborough Bridge and Tunnel Authority, an agency of the Metropolitan Transportation Authority, for negligence.

According to the complaint, on August 31, 2020, Valencia was required to operate a gas-powered demo saw. Beforehand, his employer Triborough Bridge and Tunnel Authority failed to provide him with facial safety equipment and any other safety equipment necessary for the performance of the task assigned, the suit says.

Valencia also alleged that the company failed to provide adequate manpower for the job at hand. Valencia alleges that he suffered "grievous and painful injuries to his body and limbs and damage and injury to his nervous system and became sick, sore, lame and disabled, causing him to be incapacitated from the performance of his usual occupation or duties."

Valencia is represented by Steven A. Schwartz Esq. of Levidow, Levidow and Oberman, P.C.
