JONESBORO, Ark. (Legal Newsline) -- A woman claims to have contracted hepatitis A infection from a Steak N Shake employee.
Ida Jean Brooks filed a complaint on June 2 in Arkansas' Craighead County Circuit Court against Burger Joint LLC d/b/a Steak N Shake and John Does 1-10 for strict liability, negligence and breach of duty owed to business invitee.
According to the complaint, Brooks and her granddaughter ate at a Steak N Shake located at 2303 East Parker Road Lakeshore Drive, Jonesboro, Ark. on May 27, 2018 and June 3, 2018. After eating at the location, she began developing symptoms of nausea, fatigue, dizziness and loss of vision and allegedly went to the E.R. on June 10, 2018.
Unknowin to Brooks at the time, a food preparation-employee was infected with hepatitis A, which is contagious, the suit claims. Brooks allegedly followed up with her primary doctor on June 14, 2018 when the symptoms had not subsided. It was at this appointment that test came back for hepatitis A infection. Brooks alleges that it is at the fault of Steak N Shake.
Brooks seeks compensation for injuries and damages including: damages for general pain and suffering; damages for loss of enjoyment of life, both past and future; medical and medical-related expenses, both past and future; travel and travel-related expenses, past and future; emotional distress, past and future; pharmaceutical expenses, past and future; and all other ordinary, incidental, or consequential damages.
