BENTON, Ill. (Legal Newsline) — Chobani is facing a lawsuit alleging its Chobani Complete Greek yogurt does not contain additional probiotics or all natural ingredients as its label claims.
Lori Gilker, individually and on behalf of all others similarly situated filed a complaint May 16 in the U.S. District Court for the Southern District of Illinois against Chobani LLC alleging violation of the Illinois Consumer Fraud and Deceptive Business Practices Act, breach of express warranty, implied merchantability and the Magnuson Moss Warranty Act, negligent representation, fraud and unjust enrichment.
Gilker claims in the class action that Chobani has false, deceptive and misleading claims regarding its low-fat Greek yogurt sold as Chobani Complete. Specifically, Gilker alleges the yogurt does not have all the "necessary and appropriate parts" to be labeled as "complete nutrition" and is falsely labeled as containing more probiotics.
She also alleges Chobani is causing consumers to pay more for the product with false claims the yogurt has "natural ingredients" and that the yogurt contains "monk fruit extract" which are not natural and not obtained "without harsh processing and additives." Gilker also claims she and other class members have been harmed by Chobani's misrepresentations and "half truth" statements on its product label.
Gilker seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Spencer Sheehan of Sheehan & Associates PC in Great Neck, New York.
