NYC sued for allegedly allowing playground tree to grow into neighboring property

NEW YORK (Legal Newsline) - A company sued the City of New York for allegedly neglecting a tree until it began to grow onto their property.

The complaint was filed on April 19 in the New York County Supreme Court by plaintiff Everton Properties LLC against the City of New York, the New York City School Construction Authority and the Department of Education of the City of New York. Everton Properties owns the property at 1131 Broadway in Brooklyn. Next to the property is a school playground area. 

The plaintiff alleges that a tree on the playground area has been neglected by the defendants and has grown into the plaintiff's east wall. 

Everton Properties says that any attempts to remedy the issue with the defendants have failed and a notice of claim was served in February. 

The defendants are charged with negligence and nuisance. 

The plaintiff is represented by Quinn McCabe LLP of New York City.
