Lawsuit: Arkansas woman crushed by railroad ties seeks payback from Tractor Supply

FAYETTEVILLE, Ark. (Legal Newsline) - An Elkins, Ark., woman called out Tractor Supply in the Washington County Circuit Court after her legs were allegedly crushed by railroad ties at the farm retailer's Springdale location. 

According to the complaint filed on March 19 by plaintiff Donna McDaniel, she was shopping in the Tractor Supply with her husband on June 2, 2018, for railroad ties. McDaniel says she was instructed by one of the defendant's employees to use a pair of tin snips to cut open a bundle of railroad ties, which are held together by a metal band. 

When McDaniel cut the band as instructed, the force of the heavy bundle exploded outward and caused four of the ties, which weigh over 200 pounds apiece, to land on her legs. McDaniel's injuries, including bone fractures, required surgery. 

Tractor supply is charged with negligenceThe plaintiff demands a jury trial to determine the appropriate compensation for her injuries. She is represented by the Daniels Law Firm of Fayetteville.
