Widow's lawsuit against Amtrak and Conrail: Asbestos, diesel exposure caused husband's colon cancer

BOSTON (Legal Newsline) - A Florida woman filed a lawsuit against the Consolidated Rail Corporation and National Railroad Passenger Corporation (Amtrak) after allegedly unsafe working conditions caused her relative's death. 

Plaintiff Anne Mason filed the suit April 2 in the Massachusetts Superior Court in Suffolk County on behalf of the estate of John Mason, who worked for the defendants as a signalman and signal maintainer.

According to Mason's complaint, the decedent was exposed to unsafe excessive levels of diesel exhaust, creosote and asbestos on a daily basis. The plaintiff alleges that the decedent's colon cancer was a direct consequence of his regular exposure to the harmful substances. 

Mason requests at least $50,000 from each defendant for their alleged negligence in identifying and remedying a harmful workplace that led to the decedent's wrongful death in violation of the Federal Employer's Liability Act.
