Railroad complains in lawsuit land owner is tearing up its track

FLORENCE, S.C. (Legal Newsline) – A battle over whether a railroad track has been abandoned has spilled over into South Carolina federal court.

South Carolina Central Railroad sued Sonoco Products Company on March 25 in Florence, claiming the defendant is dismantling some of its track in Hartsville without authority to do so.

SCCR says it owns the track and has not abandoned it.

“Plaintiff has, on multiple occasions, in writing and otherwise, insisted that Defendant cease and desist from trespassing on and vandalizing and destroying Plaintiff’s property,” the lawsuit says. “Defendant has expressly declined to abide by these requests and contends without any support that the subject property has been abandoned.”

SCCR seeks an injunction against the destruction of its track. It is represented by Tecklenburg & Jenkins.
