Man sues Playboy for watching his mouse while he's on its website

LOS ANGELES (Legal Newsline) – A Florida man is suing Playboy in California under a Florida law, claiming it illegally tracked his activity while surfing its website.

Lathario Scott sued Playboy Enterprises on Jan. 20 in Los Angeles Superior Court, and the defendant removed the case to federal court on March 18. The suit alleges violation of the Florida Security of Communications Act.

Scott says he visited the Playboy website eight or nine times in the previous year, during which time Playboy used session replay software to record his interaction with the site.

That interaction includes mouse clicks and movements, information inputted and pages viewed by him.

“Plaintiff was never notified that his electronic communications were being intercepted, and Plaintiff never consented to interception of his electronic communications by Defendant,” the suit says.

Edelsberg Law and Hiraldo P.A. are representing Scott.
