BROOKLYN, N.Y. (Legal Newsline) – Activision Publishing misled wannabe rockers for four years about the songs that would be available on the popular video game Guitar Hero Live.
That’s the allegation filed by lawyers at Reese LLP in New York federal court on March 11 in a class action lawsuit. The case follows an elimination of 92% of songs on Dec. 1, 2018 and is on behalf of players who bought in-game currency with the hope of buying those songs that eventually became lost.
The plaintiff says he wouldn’t have bought the game, or wouldn’t have paid as much for it, if he knew the songs would be eliminated from “the world’s first playable music video network.”
“Plaintiff and other consumers reasonably relied to their detriment on Activision’s misleading representations,” the suit says.
“Had Defendant not made the false, misleading, and deceptive representations, Plaintiff and other consumers would not have been willing to pay the same amount for the Products they purchased, and, consequently, Plaintiff and the other consumers would not have been willing to purchase the Products.”
