NEW YORK (Legal Newsline) - The City of New York and multiple other defendants are facing civil charges from a Bronx man who says he was wrongfully stopped, questioned, searched, arrested and detained by the NYPD in 2015.
In a lawsuit filed on Feb. 15, Ramon Hernandez alleged that his civil rights under the New York and U.S. constitutions were violated when he was stopped by a group of officers while walking down the street in the Bronx just after 3 a.m. on Feb. 5, 2015.
The suit says that 10 officers ordered Hernandez to stop walking and aggressively placed the plaintiff under arrest without explanation.
The officers did not have any reason to believe that Hernandez had committed any crimes, according to the suit. The claims say that the officers fabricated evidence and violated police conduct to justify the man's arrest and prosecution in an alleged robbery.
The fabricated evidence then allegedly initiated prosecution against Hernandez, who says he was racially profiled for the stop, search and arrest, and was unlawfully detained for almost two years.
Hernandez is suing the City of New York and other defendants for unlawful search and seizure, false arrest and false imprisonment, assault and battery, use of excessive force, malicious prosecution, malicious abuse of process and other alleged violations.
For each cause of action, Hernandez is seeking damage reimbursement that exceeds the arbitrational limit of lower courts.
The other defendants in this case include: law enforcement officers Christopher McGrisken, Amadeo Oktrova, Steven Lopez, Robert Barnett, Angel Gonzalez, Joseph Delio, Daniel Collins, Kevin To, Mark Lopez and Christopher Lopez.
