Feds seek cleanup costs from Wisconsin Public Service Corp.

GREEN BAY, Wis. (Legal Newsline) – The United States is suing the Wisconsin Public Service Corp. for cleanup costs at a site in Manitowoc County.

On behalf of the Environmental Protection Agency, the feds filed suit Feb. 18 in Wisconsin federal court under the Superfund law. The site in question is a former gas plant operated by Wisconsin Fuel & Light Company, a predecessor in interest to WPSC, up until 1947.

The site takes up two acres in Manitowoc and has been contaminated by benzene and naphthalene, the suit says.

“The site also includes surrounding areas where contaminated groundwater, soil and river sediment have come to be located,” the suit says. “The manufactured gas plant was the source of hazardous substances that contaminated the site, and remain at portions of the site.”

The EPA issued a Record of Decision for one of the units of the site for remediation. The suit seeks compensation for all past and future response costs incurred by the United States.
