CHICAGO (Legal Newsline) – Litigation has followed a U.S. House subcommittee report that claims some baby foods are tainted with materials like arsenic, lead, cadmium and mercury.
One such lawsuit is the proposed class action filed by Aileen Garces in Chicago federal court on Feb. 8 against Gerber Products and The Hain Celestial Group. Garces is represented by Thomas Zimmerman of Zimmerman Law Offices.
Four days earlier, the Subcommittee on Economic and Consumer Policy released a report that said several brands of baby food contain unsafe levels of toxic heavy metals.
“Given the health risks associated with high levels of toxic heavy metals, the presence of these substances in baby food is a material fact to consumers,” the suit says. “Indeed, consumers – such as plaintiff and members of the class… - are unwilling to purchase baby food that contains unsafe levels of toxic heavy metals.”
The suit brings claims under the consumer protection act of every state as it seeks to represent a nationwide class.
