NEW YORK (Legal Newsline) – There’s more to chocolate-covered fruit than the front of the package says, a class action lawsuit alleges.
Lawyer Spencer Sheehan is targeting Mars Wrigley over its Dove chocolate-covered fruit products that promise “real mixed berries” and “made with real fruit” while showing strawberries, cranberries or blueberries “dipped in silk smooth dark chocolate.”
Consumers expect these products to contain only two ingredients – chocolate and fruit – says the Jan. 23 complaint in New York federal court.
“For instance, the cranberries, strawberries and blueberries all contain added sugar,” the suit says. “The strawberries also contain citric acid, natural flavor and ascorbic acid.
“In the context of chocolate-covered fruit, the ‘made with real fruit’ statement and pictures of the fruit causes consumers to expect fruit ingredients that are not modified by sugar, citric acid, natural flavor and ascorbic acid.”
