Mass. AG's settlement gets $240K for City of Lynn, targets alleged pollution

BOSTON (Legal Newsline) – A Massachusetts coating and adhesives plant has settled claims it released hazardous chemicals into the air.

A consent decree entered Jan. 19 in state Attorney General Maura Healey’s lawsuit against C.L. Hauthaway, in Lynn, says the company has retained a third-party environmental consulting firm to help it upgrade its inventory management system.

A new stormwater pollution prevention plan will enable the company to comply with the Clean Water Act and Clean Air Act, the settlement says.

C.L. Hauthaway will also pay the City of Lynn $240,000 and reimburse Healey’s office with $62,000.

Healey’s December lawsuit claims the company has discharged industrial stormwater into the Saugus River without a discharge permit.

“The neighborhood surrounding the facility has been identified by the Commonwealth and EPA as an Environmental Justice community because it has the potential to be disproportionately impacted by environmental harm and risks,” the lawsuit says.

Healey’s office charges the company with inadequate management of hazardous chemicals, like one known as TDI. It is used in the manufacture of polyurethane flexible foam and non-foam urethanes, the suit says.

TDI is present at the facility in amounts exceeding the law, the suit says.
