As Lincoln moves to stop booze sales at 11, gentlemen's club sues

LINCOLN, Neb. (Legal Newsline) – A gentlemen’s club is suing the Nebraska city of Lincoln over a new directive that would shut its doors at 11 p.m.

Rena Inc., which operates the Foxy Gentlemen’s Club in the city, complains that such a rule, prompted by the COVID-19 pandemic, violates the First and 14th amendments of the U.S. Constitution, as well as articles in the state constitution.

The directive says alcohol sales will cease at 10:45 p.m. and establishments can only stay open from 11 p.m. to 1 a.m. for the purpose of selling to-go alcohol.

“Lincoln’s continuing local restrictions on businesses has had a devastating financial impact on the plaintiff’s business and its employees,” the lawsuit says.

“Lincoln’s directive is irrational and arbitrary on its face and lacks any legislative predicate for significant limitations placed on business establishments, such as the Foxy.”
