Lawsuit challenges Minnesota's move to regulate vehicle emissions

MINNEAPOLIS (Legal Newsline) – A trade association is taking aim at Minnesota’s new proposed vehicle emission standards by challenging them in federal court.

The Minnesota Automobile Dealers Association filed a lawsuit Jan. 6 against the Minnesota Pollution Control Agency, which is introducing emissions standards equal to California’s beginning in model year 2025.

This is illegal, MADA says, because the federal Clean Air Act regulates emissions – not states.

“Members of MADA will be forced to incur substantial economic costs and harms if Minnesota is allowed to proceed with its illegal adoption of California’s motor vehicle emission standards,” the suit says.

“Under MPCA’s proposed rules, manufacturers can sell only California cars in Minnesota and must ship an increasing percentage of (zero-emission vehicles) in accordance with the ZEV mandate.”

The MPCA issued its notice of intent to adopt the rule on Dec. 21 and is planning online information sessions in the coming weeks.
