NEW YORK (Legal Newsline) – There is no “extra life” and “extra power” in Duracell’s size AA batteries, a new lawsuit alleges.
Sheehan & Associates, representing Robert Ferguson, sued the company Dec. 19 in New York federal court, claiming consumers are misled by claims made on the batteries’ packaging and marketing.
A disclaimer on the back of the packaging tells a different story than what’s on the front, the lawsuit says.
“Contrary to the front claims, the disclaimer tells consumers the disappointing truth – the product may have a longer life or provide extra power – but not both – only compared to Defendant’s Coppertop batteries,” the lawsuit says.
“Moreover, these limited ‘benefits’ only occur in an unspecified (read: small) ‘range of devices.’”
This disclaimer is too small to be deemed informative to consumers, the suit alleges.
