Clock on car seats is ticking, lawsuit against Graco says

TRENTON, N.J. (Legal Newsline) – Graco has been hit with a class action lawsuit that complains it sells products already more than a year old while warning customers they will only be safe for about 10 years.

Matthew Schmitt complains in a Nov. 16 lawsuit in New Jersey federal court that the car seat he bought for his daughter was already 15% toward the end of its life when he bought it on Aug. 31. A sticker on it said it was manufactured in March 2019.

The manual instructs users to throw the seat away 10 years after the date of its manufacture.

“This fact was not disclosed to Plaintiff prior to purchasing the seat and Plaintiff was unaware that the car seat he had purchased was so far into its useful life period until after he had received it,” the lawsuit says.

“It is, in fact, impossible for online consumers to know that they are buying partially expired car seats from defendants, nor do defendants warn their customers that they are likely purchasing partially expired car seats.”

The law firm Dressel/Malikschmitt filed the case.
