BUFFALO, N.Y. (Legal Newsline) – New York officials are the target of a new lawsuit that challenges how and why it is decided that certain public places are allowed to reopen during the coronavirus pandemic.
Theater-owner QC Properties sued Gov. Andrew Cuomo, Attorney General Letitia James and health commissioner Howard Zucker on Oct. 12 in Buffalo federal court.
The suit complains that malls, gyms, restaurants and places of worship have all been allowed to reopen but movie theaters have not been.
“Defendants’ decisions and reasoning lack transparency,” the suit says. “Defendants have not disclosed or identified the alleged ‘science or data’ they claim justifies their decision to leave shuttered only the movie theater industry.”
