Lawsuit: Switching to Switch Lite doesn't fix Nintendo drifting problem

SAN FRANCISCO (Legal Newsline) – Nintendo faces another class action lawsuit over its controllers.

With litigation over its Joy-Con controllers already pending in arbitration, attorneys at Faruqi & Faruqi in Los Angeles on Oct. 5 filed their own class action in California’s Northern District.

Plaintiffs allege the controllers cause characters or cursors to drift even when they are not moving and that Nintendo knew about the problem.

“Once the defect manifests, it progressively gets worse until the Joy-Cons become inoperable and consumers are forced to buy a new pair of controllers,” the suit says.

“Defendant has known and had exclusive knowledge of the problem for years, and still, has done nothing to adequately fix it or alert consumers of its existence.”

Changing to the Switch Lite doesn’t work either, the suit says, as it and Joy-Cons have similar design features that cause the same defect.
