NEW YORK (Legal Newsline) – Sara Lee’s pound cake shouldn’t be labeled as all butter, a class action lawsuit says.
The firm Sheehan & Associates sued Sara Lee on Sept. 4 in New York federal court because soybean oil is listed as an ingredient.
“Where a food is labeled ‘butter’ or uses the word ‘butter’ in conjunction with the food name, reasonable consumers will expect all of the shortening ingredient to be butter,” the suit says.
“The representations are misleading because butter is not the only shortening ingredient in the product…”
Sara Lee sold its product at a higher price than it would have if it hadn’t labeled the cake as all butter, the suit claims.
