Debt collector fights for its right to call debtors more than twice a week

BOSTON (Legal Newsline) – A debt collector is suing Massachusetts Attorney General Maura Healey, claiming an unconstitutional requirement violates its right to free speech.

Credit Acceptance Corporation filed its case Aug. 21 in Massachusetts federal court in an effort to block a law that prohibits it from attempting to call its customers more than twice per seven-day period.

“Creditors’ ability to reasonably communicate with their customers is essential to helping customers bring their accounts current and minimizing the risk of repossession,” the suit says.

“By reaching a customer who is unable to make payments, a creditor such as Credit Acceptance is able to ascertain the customer’s situation and work out payment arrangements.”

Healey has threatened to enforce the regulation against CAC and subject the company to penalties, the suit says.
