SAN JOSE, Calif. (Legal Newsline) – Shutterfly is hassling parents with pictures of their children, a new class action lawsuit filed Aug. 27 claims.
The lawsuit by plaintiffs Don Cullen and Ellen Ross says Shutterfly’s Family Approval Program twice a year takes school pictures and sends unsolicited copies to parents with the option to purchase.
The proposed class action says this is a violation of the Consumer Legal Remedies Act, the Unfair Competition Law and the Postal Reorganization Act.
“Despite the unsolicited nature of the photographs, Defendants maintain that any photographs that are not returned must be paid for and send parents reminders for payment,” the suit says.
“This is despite the fact that Defendants know this to be unlawful. For example, they have warned investors that such practices may open the company to liability.”
The case is filed in San Jose federal court by San Francisco firm Gutride Safier.
