PORTLAND, Ore. (Legal Newsline) – Jelly has Kroger in a jam, as a new class action lawsuit says its spreadable fruit products are misleadingly named.
For example, says the Aug. 6 case filed by Sarah Vitort in Portland, Ore., federal court, the label says “Just Fruit.”
“Defendants uniformly represent that the Product contains only the fruit identified,” the suit says.
“However, the ingredients list on the back label reveals that the Product is made primarily with ‘fruit syrup,’ and contains other sweeteners, added sugars and additives such as ‘pecting,’ ‘calcium citrate,’ ‘apple juice concentrate,’ and ‘citric acid.’”
Reasonable consumers say they have paid more for a product they expected to be “just fruit” than they would have if they had read the ingredients list and found out the jelly contained other ingredients.
