Ancestry.com sued over automatic membership renewals

Federal Court
Contract 08

SAN DIEGO (Legal Newsline) – A class action lawsuit that alleges Ancestry.com violates membership laws in California is now in federal court.

The company removed the San Diego lawsuit against it on July 29 as it fights allegations it enrolls members in programs that feature automatic renewals without first obtaining their affirmative consent, in violation of the California Automatic Renewal Law.

“If Plaintiff had known that Defendants were going to enroll her in an automatically renewing program that would result in additional charges being posted to her credit card, Plaintiff either would not have submitted her credit card information to Defendants or would have cancelled…” the lawsuit says.

“There are hundreds of customer complaints about Ancestry.com posted on various consumer websites, including but not limited to the Better Business Bureau.”

Zach Dostart of Dostart Hannink & Coveney is representing plaintiff Marta Carrera Chapple.
