Children's and infant's pain relievers shouldn't be priced differently, lawsuit says

LOS ANGELES (Legal Newsline) – A class action lawsuit accuses Kroger of selling two identical acetaminophen products for children at radically different prices.

Reynolds Hartwich’s July 14 lawsuit in Los Angeles federal court follows a similar case against Walmart. They note that the amount of acetaminophen in children’s pain reliever and infants’ pain reliever is the same, but infants’ pain reliever is sold at a much higher price.

“In both Ralphs’ online and in-store locations, the Infants’ Products cost approximately three times as much per ounce than Children’s Products for the same amount of medicine,” the suit says.

“No reasonable consumer would pay approximately three times more for Infants’ Products, as compared to Children’s Products, unless he or she was deceived into thinking that infants cannot safely take Children’s Products.”

The law firm pursuing the case is Pearson, Simon & Warshaw.
