CHICAGO (Legal Newsline) – Users are dragging TikTok into court in Illinois, where a state law forbids the storage of facial features without approval.
A class action lawsuit filed June 26 alleges violations of the Illinois Biometric Information Privacy Act, a state law that targets the collection of facial recognition information.
“Defendants fail to disclose or obtain consent for this collection, use or storage,” the lawsuit says. “And they further fail to disclose why they collect, use and store Defendants’ biometric data, who has access to the data, or how long the data will be retained – all of which is required by law.”
Lawyers at Fegan Scott filed the case, which seeks to certify a class of all Illinois residents whose biometric information was captured by TikTok and/or the Musical.ly apps.
TikTok, which allows users to produce short videos, has been downloaded more than 2 billion times, the lawsuit says.
