NEW YORK (Legal Newsline) – A subscriber to The New York Times is alleging it unfairly and automatically renewed her agreement.
Maribel Moses filed a class action lawsuit against The New York Times Company on June 17 in New York federal court alleging violation of a California law against automatic renewals. She lives in that state.
She says NYT failed to present the automatic renewal offer terms in a clear and conspicuous manner, charged her without first obtaining her consent and failed to inform her about how to cancel the automatic renewal terms.
“During the life of Ms. Moses’s NYT Subscription, Defendant’s practices with respect to billing also varied widely from month-to-month and were therefore a source of continual frustration for Ms. Moses,” the lawsuit says.
“Because Defendant tended to charge Ms. Moses’s Payment Method at different points of each month, Ms. Moses could not discern any regular monthly billing schedule. Moreover, Ms. Moses had not expected that Defendant would charge a renewal fee to Ms. Moses’s Payment Method twice for certain months, as Defendant did in March 2020.
“Ms. Moses’s confusion and surprise with respect to Defendant’s billing practices is the direct result of Defendant’s failure to place Ms. Moses on notice of the recurring amount that would be charged to Ms. Moses’s PayPal account as part of her NYT Subscription.”
