HOUSTON (Legal Newsline) – A golf entertainment company is taking its second shot at suing Topgolf for alleged antitrust law violations.
SureShot Golf Ventures filed a lawsuit May 18 in Houston federal court against Topgolf, which operates entertainment facilities featuring driving ranges, over its acquisition of Protracer. The first lawsuit failed, but a federal appeals court ruled in 2018 the dismissal should be without prejudice, leaving the chance to refile.
SureShot said it was formed to compete with Topgolf but has not been able to because of a monopoly.
“The SureShot model was going to use high-speed video cameras and software that would track the balls in flight, creating a unique, immersive 3-D ball flight and gaming experiences for customers,” the complaint says.
SureShot says it worked with Protracer, a Swedish company, to build a prototype center. They signed an agreement in 2015, the lawsuit says, but a year later Protracer signed an agreement with Topgolf.
