LOS ANGELES (Legal Newsline) – The maker of popular car seats for children is facing a class action that alleges it has known for nearly 20 years that its products are not safe for kids under 40 pounds and under 4 years old.
Emilio Pensada filed a class action on May 1 in Los Angeles federal court against Graco through attorneys at Greg Coleman Law in Los Angeles and Tennessee.
The complaint revolves around safety claims made by Graco about its booster seats. It takes issue with the company claiming they are safe for children 30 pounds and over and as young as 3 years old.
“Graco’s labels and marketing claims deceive parents of young children by making them believe that the Booster Seats provide side-impact protection without revealing that those representations are virtually meaningless,” the lawsuit says.
“Notably, there are no federal or state standards for side-testing of booster seats. Graco is basically making up their own ‘test’ and then telling the consuming public that their Booster Seats passed when they, in fact, do not pass any test that establishes the safety of the seat for children in a side-impact collision.”
