Payroll company faces lawsuit for allegedly storing fingerprint, palm scans data

CHICAGO (Legal Newsline) — A New York-based human resources and payroll provider faces a class action complaint alleging it is illegally collecting and storing employees' biometric data through the use of timekeeping equipment that captures fingerprint and palm scans.

Arturo Bedolla, individually and on behalf of all others similarly situated, filed the complaint on March 13 in the Circuit Court of Cook County Illinois against Paychex of New York LLC alleging violation of the Illinois Biometric Information Privacy Act (BIPA). The defendant recently removed the case to Chicago federal court.

Bedolla alleged he was required to use Paychex biometric timekeeping devices throughout his employment, which captured, stored and disseminated his biometric data. He claims Paychex failed to inform him about the handling of his and other's biometric data or to get their consent to collect the data. 

The plaintiff seeks monetary relief of $6,000 for each violation of Illinois' BIPA, trial by jury, interest and all other just relief. He is represented by Timothy Kingsbury and Andrew Heldut of McGuire Law PC in Chicago.
