S.C. woman suing low-budget airliner over COVID-19 cancellations

DENVER (Legal Newsline) — A South Carolina woman filed a class action complaint against Frontier Airlines Inc., over its refusal to provide a refund for a canceled flight due to the COVID-19 outbreak. 

Melissa Young, individually and on behalf of others similarly situated, filed the complaint on April 23 in the U.S. District Court for the District of Colorado against Frontier Airlines Inc., alleging unjust enrichment, fraud and other claims.

Young contends she purchased round-trip tickets for herself, son and husband in March to fly via Frontier from Myrtle Beach to Long Island on May 19, according to the complaint. The airliner allegedly canceled the flight due to the COIVD-19 outbreak.

Young alleges the airliner agreed to provide her with a cash refund in a phone call on March 19, according to the complaint. However, after following up with the company, Young claimed Frontier said it never offered a cash refund and was willing to provide a travel refund, according to the complaint, which was similar to an initial email about the canceled travel. 

The plaintiffs seek monetary relief, trial by jury, interest and all other just relief. They are represented by Scott Kamber and Michael Aschenbrener of KamberLaw LLC in Denver, Yeremey Krivoshey, Andrew Obergfell and Max Roberts of Bursor & Fisher PA in Walnut Creek, California and New York.
